Resumen. Esta carta continúa desde aquella emitida antes sobre los cambios en el  estado de márketing digital con la emergencia de los medios sociales. En quince días, vamos a discutir cómo PyMEs puedan aprovecharse de FaceBook, el medio social más popular en México; en un mes, una discusión sobre márketing por PyMEs a través de Twitter, Linked-In y Pinterest; así como, en seis semanas, una revisión del estado general de publicidad virtual. El objetivo de esta serie es para presentar la disponibilidad de anuncios en línea a las PyMEs sin los servicios de mercadotécnicos.
Summary: The Boogie Woogie Google boy of Company-B! This week’s letter continues from that issued a fortnight ago about the ‘Winds of War’ blowing across the digital marketing space as social media begin to square off against GOOGLE. GOOGLE has the muscle with analytical data available to users of AdWords, whereas social media provide the personal data to enable targeted and interactive ads. This mini-series of marketing takes a 10,000 foot view of how the leading marketing channels work and how they are open to everyone, besides the household names.
Todavía, un problema de alta clase. Es importante para enfatizar que GOOGLE no está muriendo ni en declive; como cada empresa de gran éxito, GOOGLE ha llegado a una meseta de su propio poder en el mercado. Se parece como es estancado pero no es necesariamente. El lujo de ganarse casi un TRILLÓN de pesos de ingresos anualmente desde AdWords es el tiempo para responder a los rivales emergentes. GOOGLE’s challenge. After the last marketing letter, I really owe it to y’all to emphasize that GOOGLE is not dying nor in immediate decline. But, like many muscle-bound giants, the data-diva has hit that plateau that so many enormously successful companies do; in a sense, the cookie-monster has gotten too good at what it does for its own good. Messrs Brin and Page deserve credit for trying to keep the company nimble. Yet investments in search engine infrastructure that locks in a formula for success, likely to be obsolete at some future date, certainly keep these billionaires up at night.

El desafío para GOOGLE es grave a causa del fracaso de GOOGLE+ para responder adecuadamente frente a las redes mencionadas por medio de un paquete comprensivo de GOOGLE Hang-Outs (frente a SKYPE), GOOGLE+ y g-mail (para integrar comunicaciones y el márketing directo).
The social media are making a charge at the GOOGLE’s ‘diamond as big as the Ritz’, by trying to cash in on more idiosyncratic data. Facebook is the more immediate challenge, especially B2C. Linked-In could be a player on the B2B side if it ever got its act together. This challenge for GOOGLE remains very serious since its response – a roll-up of various media into GOOGLE+ -- has failed to slow Facebook’s ad growth.

Basics of AdWords by GOOGLE. Most smaller businesses and start-ups have some familiarity with AdWords. The mechanics of bidding on keywords seems to lack transparency. In actuality, GOOGLE seeks to level the playing field by awarding the winning bid based not only on the highest pricing submitted but also on the content relevance and quality backing the key-words. GOOGLE’s mechanism is wise in that it elevates user experience and, therefore, its brand above immediate income.

Con la inclusión de información de redes sociales, una internauta en la primera parte del proceso de compras podría llegar a GOOGLE y, luego, moverse rápido hacia un perfil de una empresa en FaceBook o Twitter para comprometerse con tal marca mediante la publicidad social embebida en sus perfiles. Tal vez GOOGLE podría monetizar esta transición desde búsqueda hasta compromiso en virtud de una nueva forma de publicidad. Now that Google engine results include tweets and Facebook profiles, a user is more likely to ricochet from GOOGLE’s localized search results into the social media to narrow down the buying possibilities and spin that brand-waltz into a sale. Currently, there is the possibility – sheer fantasy on my part – that GOOGLE can monetize this “Bang! Zoom!” referral, as it is starting to do with an agreement with Twitter, through a click-through ‘assist’ payment for accessing the Facebook page via GOOGLE+ or GOOGLEmaps.

Sin embargo, el proceso de usar AdWords ya es bien conocido. La mayoría de PyMEs se enfoca sus anuncios en mercados localizados, en los que FaceBook tiene mucho más datos sobre el comportamiento de los usuarios. Además, GOOGLE tiene desventajas para campañas de vigencia limitada.
At this point, GOOGLE is trying to slow the erosion of its dominance in ad revenues, which is still mind-boggling with some $6bn of sales per month! Nevertheless, facing up to Facebook remains daunting since the social network, together with its chatty kin, have many more personal data, if less muscular analytics than, GOOGLE.

Finalmente, sólo entre 6-30% de internautas hacen clic sobre un anuncio de AdWords frente a un sitio web proveído orgánicamente (en virtud de la fortaleza del sitio); es decir, fuera de sectores específicos (e.j., viajes), los resultados de búsquedas son útiles para referencia y no necesariamente para impulsar compras. A distinct minority (my guess=25%) of users click on the paid ads versus sites showing up organically (i.e., based on content, reference links, etc.). Paid ads on BING, GOOGLE and Yahoo! tend to work best in certain industries, often driven more by timing and off-peak pricing (e.g., hotels). Since earning a first-page showing often costs more over time than AdWords, SMEs may be best advised to focus their effort on social media adverts.

TECNOJUANA; 23.03.15: 2nd part (IP), 2° paso-P.I.: implicaciones para México BILINGÜE

Resumen. En la primera parte de nuestra discusión sobre el segundo paso de doce hacia la transferencia de tecnología, explorábamos la naturaleza de la propiedad industrial (P.I.) en México. Ahora, vamos a discutir dos cambios de políticas, en virtud de esta discusión (basada en dos lecturas excelentes desde la European Journal of Development Research y los Financial Times).  Al principio, quiero contar dos historias personales para ilustrar en términos cotidianos la significación de cada lectura.
Summary. In the first installment of this second step of the 12-step tech transfer process, we reviewed the current levels of intellectual property (I.P.) protection in Mexico and how they applied to Tijuana’s emerging tech ecosystem (sic). Drawing upon the excerpts translated for this week from The Financial Times and The European Journal of Development Research, I put on my old (and frayed) policy-wonk hat to talk about what Mexico really needs to do to rise as a tech star in the OECD. First, I digress with two personal ‘panicdotes’.

Impacto del régimen de la P.I. en México. Como se detalla en la primera lectura del Dr. Shadlen, la República protege la P.I. tan cuidadosamente como el resto de NorteAmérica, Europa y Japón; está bien excepto, como mostrado en el cuadro a continuación, México es más como Brasil o la India que los U.S.A. Por tanto, hay poca innovación interna todavía, a pesar de la Ley de Ciencia y Tecnología (2009; entre 2-5%); no hay una transferencia de tecnología tampoco.
How I.P. protection really works in México. As the first reading argues, Mexico conforms her I.P. protections to the same standards of the leading economic powers. Yet Mexico’s level of economic development resembles that of Brazil or India. Each has swallowed the bitter pill of humility to relax ridiculous standards. Yet, despite the growth of innovation after the promulgation of the Mexican version of the Bayh-Dole Law, in 2009, still only 2-5% of patents go to Mexicans.

As the second article makes plain, the pratical protection open to Tecnojuana lies in Non-Disclosure Agreements. 3D-Robotics is a tell-tale example. One hears a great deal in the press about how this drone-maker is the poster-child of the mega-region collaboration. Yet 3D-Robotics really is just another maquiladora; its shine comes from a high-tech gloss and little else.

As we saw in the table above, México’s share of home-made patents – as a proxy for innovation – has been stuck at shamefully low levels throughout the life of NAFTA. It is also time to stem the STEM drain in Mexico as the Republic finds herself in the perverse position subsidizing the next generation of talent in Germany, Japan et al. 0y-vey!

Recomendaciones.  Basadas en las historias personales y el estado de P.I. en México, querría sugerir un enfoque diferente para México y Tijuana.
Excluir Japón y los U.S.A. desde la Asociación TransPacífica (T.P.P.).

Si los U.S.A. y Japón necesitan un contrapeso frente a China, necesitan un acuerdo geopolítico. La T.P.P. se empezó hace una década entre pequeñas economías para ganar el poder colectivo de negociaciones frente a los grandes poderes del Pacífico (China, Japón y los U.S.A.). Con los U.S.A. y Japón en la T.P.P., imponiendo requisitos onerosos de la P.I., los resultados para innovación interna serán los mismos que los de México en virtud de T.L.C.L.A.N.
As argued in the open letter to President Peña-Nieto, if the U.S. and Japan are so bothered by China’s rise, let them set up another NATO (SEATO) alliance. This counterpoise argument is a ruse to enable the U.S. and Japan to enter the TPP, littorally to do to the Pacific Rim what NAFTA is doing to México through ‘best practice’ I.P. protections. Yet there is a message to this madness: “We get the best; you get to practice…” Collective bargaining goes out the window.
México puede aliviar las restricciones frente a patentes. Con la base nacional de datos establecida recientemente, el gobierno podría integrar esas solicitudes de patentes por inventores mexicanos con contenidos similares a aquellos subyacentes de patentes otorgadas a los extranjeros. La L.O. podría pertenecer al mexicano identificado por I.M.P.I. en la base nacional de conocimientos después de tres o cuatro años sin actividad.
Second, issue compulsory licenses to prevent the patent-blocking. Mexico can leverage her new national knowledge data-base by maintaining current information about home-grown inventors of technologies similar to those attaining patent protection. After 3-4 years of no action by a mult-national, the government could automatically award a license to that look-alike inventor to develop the stifled technology in-country.

The Mexican Exception: Patents and  Innovation Policy in a Non-Conformist and Reluctant Middle Income Country

Países tienen que desplegar nuevos sistemas de propiedad industrial (o, intelectual; la P.I.) para conformarse a la normatividad internacional. Sin embargo, dichas reglas son suficientemente ambiguas para que naciones tengan latitud en el cumplimiento. El enfoque nacional de promulgación es crítico para el desarrollo interno del país porque este proceso define los términos de acceso a, y aplicación de, conocimientos avanzados. Al contrario a muchos otros países en desarrollo, México ha seguido los más grandes países en adoptar de estándares fuertes de P.I. Además, México ha desviado de sus pares en no alinear dichos cambios a las leyes de P.I. con políticas de apoyo gubernamental para habilidades en la ciencia, tecnología e innovación (C.T.I.).   
Countries need to implement new IP systems that conform to the international rules, but the rules are ambiguous enough to allow countries to conform in a variety of different ways. How countries go about implementing their new international obligations is of crucial importance for development, since patent regimes can affect the terms by which local actors can access and use cutting-edge technologies and technologically-intensive products. Unlike many developing countries, Mexico has enthusiastically embraced external pressures for stronger patent protection. Yet, also unlike other countries, Mexico has not complemented changes to its patent regime with measures to buttress science, technology, and innovative (STI) capabilities.   


Mucha investigación indica que la relación estadística entre las habilidades de un país y el grado de disciplina en proteger la P.I. es una curvilínea de forma ‘J’, con menos protecciones durante la fase nacional de desarrollo (es decir, el tiempo de imitación técnica, integración de los conocimientos, la ingeniería invertida para entender nuevas tecnologías) complementada por protecciones cada vez más ampliadas más tarde para apoyar nuevas capacidades mediante formas fortalecidas de protección intelectual. ¿Se podría reconciliar esta desviación de la normatividad con mediante una estrategia nacional para proteger conocimientos cada vez más avanzados? No. El nivel de las capacidades de C.T.I. sigue ser bajo.  Los beneficios de las patentes están fluyendo a los innovadores y empresas extranjeros.   
A significant body of research suggests that the relationship between countries’ capabilities and strength of IP follows a jcurve, with IP protection diminishing at early stages of industrial development, as actors develop capabilities for imitation, absorption, and reverse engineering, and later rising, as actors develop sufficient capabilities to benefit from stronger protection (Kumar 2002; Chen and Puttitanun 2005; Dutfield and, Suthersanen 2005; Maskus 2000; May 2007). Perhaps Mexico has grown into the patent regime and IP arrangements that seemed inappropriate in the 1980s are now appropriate? Yet STI capabilities remain low, and the benefits of the new patent regime appear to accrue overwhelmingly to foreign innovators (OECD 2009). 


La divergencia del régimen de patentes se puede evaluar con respecto a tres dimensiones: qué conocimientos puedan ser propiedad; los derechos de los dueños y consumidores de dichos conocimientos; así como, la duración del derecho exclusivo del dueño de la P.I.  La ley mexicana originalmente otorgaba control fuerte a los dueños de los privados conocimientos protegidos y garantizaba derechos exclusivos sobre muchos conocimientos, incluso aquellos en desarrollo.  Este régimen resultó en barreras de conocimientos y precios elevados para productos elaborados desde la P.I., sin impulsar el crecimiento interno de conocimientos.   
Variation in patent regimes can be considered along three dimensions: what knowledge can be owned as property, the rights of owners vs. users of property, and the effective duration of property owners’ rights. Mexico’s 1991 patent regime offered private rights of exclusion over a broad range of knowledge and granted the owners of the private rights extensive control over the use of their privately owned knowledge. The result was to raise the costs of technologically-intensive goods and raise the barriers to accessing knowledge, without the benefits of encouraging more innovation and more intensive use of knowledge in the economy.  


De hecho, dado los cambios en la economía mundial y aquellos en el régimen de P.I., se puede decir que, de veras y frente a  las medidas tomadas por países que habían encontrado el mismo desfase, la República ha reducido sus capacidades de C.T.I.  En 1997, Brasil adoptó un régimen casi tan estricto como aquello mexicano.  Sin embargo, el gobierno brasileño introdujo cambios significativos para limitar algunos derechos del dueño de conocimientos  junto con una campaña nacional para elevar sus capacidades de C.T.I.   
In fact, given changes in the global economy and the accompanying changes to the patent regime, one could even say that, effectively, and relative to the steps taken by other countries that faced a similar mismatch, Mexico has reduced STI capabilities. Brazil, for example, which adopted a patent system in 1997 that was nearly as strong as Mexico’s, subsequently introduced considerable revisions that effectively reduce IP-owners rights’ of exclusion while at the same time embarked on a major upgrading of the country’s STI capabilities. 


En Argentina, un país que había adoptado estándares más débiles en 1996 (y, por tanto, más alineados con su etapa de desarrollo) que aquellos mexicanos y brasileños, implementaron aún más reformas en 2000 complementadas por medidas para enfatizar el desarrollo de  la C.T.I.  En el caso mexicano,  los U.S.A. ejercen mucha influencia y se debe tenerlo en cuenta. Sin embargo, genera muchos problemas para la sociedad y su desarrollo cuando México se enfoca casi exclusivamente en su vecino al norte.   
Argentina, where the patent system adopted in 1996 was much weaker (and therefore more closely matched to the country’s level of development) than either Brazil’s or Mexico’s, nevertheless introduced further reforms in the early 2000s, while also introducing measures to increase STI capabilities.  While the USA’s influence looms large, and any effort to understand Mexican policy without taking account the role of the USA would be foolish, it would be equally problematic to focus exclusively on the bilateral relationship. 


En la vista del equilibrio de derechos entre dueños y consumidores de conocimientos, las áreas claves son licencias obligatorias (L.O.s) e importaciones paralelas. Las L.O.s permiten producirse e importarse bienes bajo patentes sin el consentimiento de los titulares de las patentes. El TCLAN, junto con nuevas requisitos de patentes impuestos por la O.M.C., permiten países para otorgar las L.O.s bajo de condiciones elegidas que cumplen con lineamientos flexibles.  Dichas condiciones incluyen negociaciones con el titular y el pago de las regalías.
With regard to the balance between the rights of owners vs. users, the key policy areas are compulsory licenses and parallel imports. Compulsory licenses (CLs) allow domestic entities (public or private) to import, produce, and distribute patented goods without the patent-holders’ consent. TRIPS and NAFTA, which share similar CL provisions, allow countries to determine the grounds on which they grant CLs, provided that a set of procedural conditions are met.  These conditions include prior negotiations with the patent holder and the payment of royalties.  


L.O.s otorgadas durante una urgencia nacional o para aplicaciones gubernamentales se llaman licencias de utilidad pública o de consumo gubernamental para liberar países desde obligaciones previamente negociadas.   Sin el retraso probable a causa de negociaciones en estos casos, tales patentes son más fáciles de obtener rápidamente.  Las leyes de muchos países incluyen términos para las L.O.s para prevenir el abuso monopolístico o la ausencia deliberada de aplicación en el mercado (es decir, contra patentes defensivas).   
CLs granted during times of national emergency or for government use, are known as “public utility” or “government use” licenses and countries are released from the obligation of prior negotiations. Because potential delays introduced by negotiations are removed in the case of public utility licenses, they are easier and quicker to grant. Most countries also include CL provisions as a remedy for “patent abuse” and nonworking of the patent.


El tema ahora es cómo los países definen la “explotación” de una patente, en particular si la importación de un producto con un patente se entiende como la explotación en el país o si, al contrario, el bien se debe fabricar en el país.  El sistema mexicano ha impuesto no solo precios inflados y gastos de licencia adicionales sino lo ha hecho sin los beneficios esperados por medio de la innovación interna.   
The issue is how countries define “working,” and in particular whether importing the good into the country constitutes working the patent in the country or, in contrast, whether the good must be manufactured locally.  Not only has the patent system imposed additional costs in the static sense of yielding high prices (of drugs) and increasing royalty payments (across the board), it has done so without generating the benefits of increasing local innovation. 


El nivel de solicitudes por extranjeros ha aumentado por más del 4x y, para 2008, representaron un 96% del total en México mientras que solicitudes por mexicanos han aumentado por un solo 12% para un mero 4% del total. Tal vez protecciones más vigilantes de la P.I. podría generar más I.E.D., comercio y licenciamiento.  Puede ser, el crecimiento de patentes extranjeras, conjunto con la aceleración de la I.E.D., comercio y licenciamiento, podría generar la transferencia de nuevas tecnologías para ampliar la capacidad interna de C.T.I.   
Non-resident applications have increased by more than 300% and by 2008 constitute 96% of the total, while resident applications have increased by 12% and constitute just 4% of the total.  Increased patent protection may lead to increases in direct foreign investment (DFI), trade, and technology licensing; the increase in foreign patents, combined with the growth in DFI, trade, and licensing, may yield an increase in the transfer of technology and knowledge, and the subsequent enlargement of local actors’ STI capabilities. 


Aunque dicho escenario es factible, los datos de patentes sugieren una realidad diferente.  Después de todo, incluso en términos absolutos, patentes originados en México han aumentado poco; son solamente el 12% más en 2008 que diecisiete años antes.   Para resumir, México adoptó un régimen de P.I. similar a un país rico donde actores internos pudieran aprovecharse de oportunidades para poseer nuevos conocimientos e integrar nuevas tecnologías. A causa del crecimiento de la población por el 20% durante el mismo tiempo, patentes internas por cápita disminuyeron en verdad.    
While that scenario is plausible, there is little in the patenting data to suggest this is occurring. After all, even in absolute terms, Mexican residents’ applications have hardly increased; they are only 12% higher in 2008 than they were seventeen years earlier.  To summarize, then, Mexico adopted a patent system as if it were a high-income country where local actors could exploit the new opportunities for knowledge-ownership and absorb new technologies. Considering that Mexico’s population grew by more than 20% over this period, in per capita terms residents’ patenting decreased.



Una repuesta posible para la República sería un cambio comprensivo del sistema mexicano de la P.I., todavía dentro de las restricciones internacionales o bi-laterales (en virtud de acuerdos específicos), para hacerlo adecuado para las C.T.I. Otra respuesta sería, como propuesto por el presidente Peña-Nieto, una ampliación de tal capacidad de C.T.I. para ampliar y alinear la base de conocimientos con el régimen estricto.  En México, el gobierno publica un catálogo oficial de drogas protegidas. Dicha práctica hace el gobierno el protector de derechos establecidos en vez de un foro mediante el que los dueños de la P.I. saben cómo proteger sus derechos si mismos mientras que los consumidores de conocimientos pueden promover sus intereses también.   
One possible response is for the country to alter its patent system, within multilateral and bilateral constraints, to make it more appropriate for the country’s STI capabilities. Another possible response is for the country to try to alter its STI capabilities to make the country more appropriate for the patent system.   In Mexico it is the government that publishes the list of protected drugs; thus another way in which state authority, rather than providing a forum for patent-holders to defend their rights (and where knowledge users can advance their own rights as well), becomes deployed on behalf of patent-holders to protect their rights for them. 


Ya que México otorga, o acepta, muchas patentes que protegen cambios incrementales, tales patentes confieren poder defensivo significativo.  Se encuentra un régimen que, a su incepción hace veinte años, excedieron estándares internacionales.  Sin embargo, este sistema más tarde se modificaba para otorgar una vigencia prolongada para complementar de esos derechos ya excesivos.   
Since Mexico grants (or accepts) many patents on incremental innovations, these patents end up being given substantial blocking power. What one sees is a patent regime that, at the time of creation in the early 1990s, exceeded international obligations with regard to the granting of patents and exercising of patent rights, and was later modified to offer excessive protection with regard to the duration of rights too. 


El aumento de los pagos para tener derechos en virtud de una licencia indica que empresas locales se han internalizado los gastos para alcanzar nuevos conocimientos.  Además, un declive significativo de demandas por violaciones de patentes en un entorno de una posesión alargada y exclusiva de P.I. indica una preferencia local para evitar la aplicación de los conocimientos protegidos por patentes.  Por tanto, los licenciatarios no fomentan reformas porque se han adaptado estratégicamente al entorno mexicano. A otra mano, los otros evitan los conocimientos exclusivos para no preocuparse de los temas de P.I.  
The increase in Mexico’s outward licensing payments indicates that local actors have internalized the costs of accessing knowledge. At the same time, a significant decrease in the level of patent litigation in a context of increased private ownership of knowledge suggests a tendency among local actors to avoid the use of patented knowledge. Actors obtaining knowledge through licensing do not press for change to IP policies because they have integrated the costs into business strategies; nor do actors avoiding knowledge because IP is no longer a concern.  


Generalmente, las asociaciones privadas de industrias mexicanas no llaman para las reformas del régimen de P.I. para elevar y mejorar los derechos de los consumidores de conocimientos.  Las alianzas posibles que hubieran existido anteriormente para reformar la ley, se han marchitado en virtud de la adaptación comercial generalizada.   
In general, Mexico’s leading industry associations do not articulate demands for modifying the patent system in such a way as to enhance and enlarge knowledge users’ rights. Any broader coalition for reform that might have existed has been withered away by the processes of adjustment.


Los beneficiarios principales del régimen de patentes en México parecen ser una elite de empresas extranjeras, algunos abogados de patentes y el Instituto Mexicano de Propiedad Industrial.  I.M.P.I. se gozan del cobro de derechos impulsado por las patentes de origen extranjero. Los tres comparten un compromiso para fortalecer las protecciones de I.P., sin una preferencia hacia políticas de inversión en el desarrollo de internos conocimientos oportunos mediante la P.I. Por tanto, no tiene la República la base de I+D+i elaborada por mexicanos para integrar diversos conocimientos y disciplinas.   
The principal beneficiaries of Mexico’s patent regime appear to be a handful of foreign firms and the coterie of law firms that represent and work for the patenting sector, as well as the Mexican patent office (IMPI), that enjoys the fee revenues generated by the significant growth in patent applications and renewals. These three actors share a commitment to strengthening patent protection, but not necessarily to increasing the local supply of patentable knowledge through investment in RD&I or local actors’ abilities to absorb patented knowledge. 


La Comisión Económica sobre LatinoAmérica y el Caribe de la O.N.U. señala que las empresas mexicanas tienden a competir a través del mundo mediante bajos costos laborales y, dentro del país, por la supresión de competición en sus sectores sin un enfoque, ni internacionalmente ni internamente, en términos de los conocimientos o la innovación.   
The UN’s Economic Commission on Latin America and the Caribbean notes (ECLAC 2008: 128) notes that Mexican firms tend to compete internationally on the basis of low labor costs and nationally by minimizing competition in their sectors, but neither internationally nor nationally on the basis of knowledge and innovation. 


Solamente, la Asociación Mexicana de Directivos de la Investigación Aplicada y el Desarrollo Tecnológico (A.D.I.A.T.) entiende los retos frente a las inversiones de I+D+i para llamar para políticas que fomentarían el desarrollo de C.T.I. no solo público sino privado. A.D.I.A.T. es un pequeño actor del sector privado que le falta una influencia todavía.
Only ADIAT has been active in diagnosing Mexico’s innovation system and pressing for more robust and systemic STI policies oriented toward enhancing private and public capabilities. Yet as ADIAT represents a small segment of the Mexican private sector, it has remained a marginal actor in the national political economy.

The season of US election conventions is upon us. Politicians will issue sentimental proclamations about their faith in America. Meanwhile, from California, we have an object lesson in why that faith has been eroding. A supposed pillar of the nation’s vigour has been revealed in its decadence. That pillar is the US patent system.


Los estadounidenses adoran razonablemente los derechos de propiedad y suponen que los derechos de P.I. siempre promoverlos. Embargo, esta suposición es errónea. Americans reasonably worship property rights and presume that intellectual property rights always promote it. But this presumption is wrong. The poster child for patents is the pharmaceuticals industry. What works in this sector is not necessarily appropriate in communications, software or elsewhere.

Bringing a new drug to market is inordinately expensive, mainly because of the need for large clinical trials.  Monopoly rights over new drugs provide a needed spur to invention. And because trials take as long as a decade, the 20year exclusivity typically granted can mean only 10 years of monopoly profits.


La industria de la tecnología es diferente: no hay ensayos clínicos aumentan los costes de desarrollo. Esto debilita el caso de monopolio. Veinte años de exclusividad no se puede justificar. The technology industry is different. No clinical trials are needed, so costs of development are lower and the case for monopoly weaker. Certainly, 20-year exclusivity cannot be justified. But as Michele Boldrin and David Levine observe in a new paper, the right policy for Silicon Valley might be to grant no patents whatsoever. Technology innovators are amply rewarded by the first-mover advantage. In the 16 months between the launch of the iPhone and the appearance of a competitor, Apple shipped more than 5m units. 


Si la necesidad de incentivos de monopolio en la industria de la tecnología es dudosa, el costo de permitirlos es claro. Considerando que una patente de medicamentos cubre un producto independiente, una patente de la tecnología por lo general cubre un bloque de construcción de un producto, tales como el aspecto de los iconos en una pantalla táctil, por citar una de las quejas de Apple contra Samsung. If the need for monopoly incentives in the tech industry is doubtful, the cost of granting them is clear. Whereas a drug patent covers one independent product, a technology patent typically covers a building block of a product, such as the look of the icons on a touch screen, to cite one of Apple’s complaints against Samsung. By patenting such building blocks, tech groups prevent rivals from using yesterday’s inventions to create tomorrow’s improved ones. Rather than spurring progress, patents can trip it up. 


Este problema ha alcanzado proporciones epidémicas en la industria tecnológica. Incluso un fabricante que paga regalías contraídas para las patentes aplicadas puede ser acusado de infracción. Microsoft escrupulosamente pagaba regalías para aprovecharse de las patentes de MP3. This problem has reached epidemic proportions in the tech industry. Even a manufacturer that does its best to license the patents it uses may be accused of infringement. Microsoft scrupulously paid royalties on MP3 patents but was sued by holders of similar patents and ordered to fork out $1.5bn in damages, though the verdict was later overturned. When not patenting building blocks, tech groups patent chunks of territory, like cats marking out their land. Last month Apple secured a patent for a swath of products using touchscreens with “four and five dimensional capability”, whatever that may mean.


Algunas patentes son ocultas para que las empresas con mucho dinero se les violen sin saberlo. Luego, los titulares de patentes demandan. El año pasado, las empresas estadounidenses gastaron hasta 400 mil millones de pesos para defenderse de las entidades 'no practicantes' o dueños de las patentes sin intención de utilizarlas para crear productos; sólo para atrapar a otras empresas en costosos pleitos para negociar un montón de dinero. Fuera de la industria de la tecnología, aún más locura.
Some patents are kept deliberately low profile in hopes that deep-pocketed companies will violate them unknowingly, at which point patent holders pounce. Last year US companies spent about $29bn fending off raids from “nonpractising entities”, also known as patent trolls, litigators who own bundles of patents with no intention of using them to build products. Outside the tech industry, more madness reigns. 


Los U.S.A. han hecho modestos esfuerzos para frenar este exceso. Una ley que entrará en vigor el año que viene va a mejorar la financiación de la oficina de patentes y reducir las incoherencias entre el enfoque de los U.S.A. y aquello del resto del mundo. Sin embargo, los EE.UU. tienen que hacer mucho para alcanzar la cordura. Sus reglas alientan mucho más solicitudes de patente que se registran en cualquier otro país, y considerando que otras economías maduras como Japón y el U.K. han visto una disminución de solicitudes recientemente, el volumen de los U.S.A. sigue subiendo.
The US has made modest efforts to rein in this excess. A law due to take effect next year will improve the funding of the patent office and reduce inconsistencies between the US approach and that of the rest of the world. But the US has a long way to go before attaining sanity. Its rules encourage vastly more patent applications than are filed in any other country; and whereas other mature economies such as Japan and Britain have seen a decline recently, the US volume keeps heading up. 


Algunos observadores creen que el sistema de patentes debe ser abolida por completo. Pero no se tiene que seguir ese razonamiento para ver que hay motivos para la preocupación. Some observers believe that the patent system should be abolished outright. But you don’t have to go that far to see that there are grounds for worry. Americans labour under an illusion that their lawyers’ paradise is good for innovation; they could hardly be more wrong!
